TERMS AND CONDITIONS
These terms and conditions are concluded between "MATOS SURF&KITE SHOP SRL" owner of the website www.matos.be with registered office at Chaussée de Ninove 124/CD, 1080 Molenbeek-Saint-Jean, Belgium, registered with the Crossroads Bank for Enterprises under company number 0877.885.632 and any natural person wishing to make a purchase via the "Matos" website www.matos.be hereinafter referred to as "the Customer".
1 – Purpose
These terms and conditions determine the rights and obligations of the parties resulting from the online sale of products offered on the Site. Each order implies knowledge and acceptance of these terms without reservation. They form an integral part of the agreement, to the exclusion of any other general or specific conditions emanating from the "Seller", unless otherwise stipulated in a written, dated and signed document. Our terms and conditions are subject to change at any time. The applicable T&C are those in force at the time of order registration.
2 – Product Characteristics
All our offers are non-binding. We are only bound by an order after having confirmed it in writing or after its execution has begun. The items offered by the company «Matos» are those appearing in the catalog published on the website www.matos.be on the day the user consults it, provided that the item is in stock. If one of the products is no longer available, the buyer will be informed before validation of their order by email or on the invoice of the products shipped in the case of an order for multiple items. These products are offered for sale within the limits of available stock.
In case of stock shortage or unavailability of an ordered product, the Customer will be informed as soon as possible and may choose between:
- Full refund of the unavailable product Credit note for a future order
- An equivalent replacement product (subject to Customer acceptance)
Description: The description of items (photographs, information, text, etc.) appearing in the catalog is as accurate as possible. However, minor variations, particularly regarding colors, may exist due to technical display constraints on screens.
Matos commits to delivering a product that complies with the essential characteristics presented on the site. If you find a substantial non-conformity of the received product compared to the description, you benefit from the legal conformity guarantee (see article 8). For kites and wings, colors may vary depending on stock arrivals. If you have a color preference, please mention it in your order comments; we will do our best to satisfy your request within the limits of available stock.
3 – Prices
The prices appearing in the "Matos" site catalog are prices including VAT in euros, including VAT applicable on the day of the order. Any change in the rate may be passed on to the price of products. "The Matos company" reserves the right to modify its prices at any time, without notification, it being understood that the price appearing on the site catalog at the time of order validation will be the only one applicable to the buyer.
In case of obvious price display error (typographical error, technical error), Matos reserves the right to cancel the order and inform the Customer as soon as possible. The Customer will then be fully refunded if a payment has been made.
The price is payable in full and in a single payment upon ordering. All orders are invoiced in euros and payable in euros.
Shipping costs: Shipping costs are not included in the product price. They are calculated based on the total package weight and destination, and are clearly and detailed displayed before final validation of your order (in the cart and/or at the payment step). These costs will be added to the total price of your order.
4 – Order
The buyer wishing to place an order online must create a "customer account" in which they will provide all requested information, create an online "cart" by selecting all chosen products, accept these terms and conditions, validate their order after checking it and make payment under the conditions provided. Order confirmation entails acceptance of these terms and conditions, acknowledgment of full knowledge thereof and waiver of relying on their own purchase conditions or other conditions. All data provided and the recorded confirmation will serve as proof of the transaction. Confirmation will serve as signature and acceptance of the operations performed. However, in order to limit fraud risks, "Matos" may conduct checks regarding the validity of payments made. In this case, the Customer is notified by email of supporting documents to be sent (by email or mail) to "Matos" to allow final validation of their order. The company "Matos" reserves the right to accept or reject the order based on the documents and their receipt. Furthermore, "Matos" reserves the right to suspend or cancel any order from a customer with whom there is an unresolved dispute. In addition, any person whose account has been closed may not re-order on the site without prior authorization from "Matos".
5 – Right of Withdrawal
In accordance with the Belgian Code of Economic Law (Book VI), you have a right of withdrawal of 14 days from the day following receipt of your order, without having to give a reason.
This right applies to all products sold on our site, including clearance, promotional or sale products.
How to exercise your right of withdrawal:
To exercise this right, you must notify us of your withdrawal decision by means of a clear statement, for example:

You may use the withdrawal form available on our site (downloadable in the "Shipping and Returns" section), but this is not mandatory. A simple clear email indicating your wish to withdraw is sufficient.
Deadlines:
- You have 14 days from the day following receipt of the product to notify us of your withdrawal decision.
- After notification, you have an additional 14 days to return the product to us.
Return conditions:
Returned products must be:
- In a condition allowing resale (we encourage you to handle the product with care)
- Complete with all accessories and instructions
You have the right to examine the product as you would in a store (try it, handle it to check its characteristics). Reasonable use to test the product is therefore accepted.
Important: If the product shows depreciation resulting from handling beyond what is necessary to establish the nature, characteristics and proper functioning of the goods, we may apply a reduction of the refund proportional to this depreciation.
Refund:
We will refund you the full amount paid, including initial shipping costs (except additional costs if you chose a more expensive delivery method than our standard option), within 14 days from the date we were informed of your withdrawal decision or receipt of the returned goods.
The refund will be made by bank transfer to the account used for payment (or to a bank account you will indicate to us).
Return costs:
The costs of returning the product are at your expense. We recommend using a tracked shipping method.
Exceptions to the right of withdrawal:
In accordance with legislation, the right of withdrawal does not apply to:
- Goods made according to your specifications or clearly personalized
- Sealed goods unsealed after delivery that cannot be returned for health or hygiene reasons (example: worn neoprene suits)
6 – Payment
The Customer has payment methods offering maximum security. An order can be paid by:
- IBAN bank transfer
- Credit card (if available)
For bank transfer payments, items can only be shipped upon receipt of payment to our bank account. For more information on payment methods, you can contact us at info@matos.be.
7 – Delivery
Delivery methods:
We offer the following delivery options:
Option 1 - Standard delivery:
- For Belgium: via Bpost with tracking number
- For international: via DHL Express with tracking number
- Indicative timeframe: 2 to 5 working days after shipment
Option 2 - Store pickup:
- Free pickup at our store: 124C Chaussée de Ninove, 1080 Brussels
- Available after receiving a confirmation email
Shipping costs are calculated based on weight and destination. They are clearly communicated to you before final validation of your order.
Delivery times:
Packages are generally shipped within 2 to 3 working days after receipt of payment. The indicated delivery times are given as an indication and may vary depending on the carrier. In case of delivery delay exceeding 30 days after the order date, you can contact us to:
- Agree on a new delivery deadline
- Or cancel your order and obtain a full refund within 14 days
Transfer of risk:
The risk of loss or damage to products is transferred to you at the moment when you yourself, or a third party designated by you (other than the carrier), physically take possession of the goods.
If the product is damaged during transport, it is our responsibility.
Receipt and verification of your package:
Upon receipt of your package, we recommend that you:
- Check the external condition of the package in the presence of the delivery person if possible
- In case of visible damage, formulate written reservations on the delivery note
- Contact us as soon as possible (ideally within 3 days) at info@matos.be with supporting photos
You have a reasonable time to examine your order. If you notice an anomaly (missing product, non-compliant, defective), you can contact us by email at info@matos.be including your order number and photos if necessary.
Important: Your right to the 2-year legal conformity guarantee remains applicable even if you did not make reservations upon delivery (see article 8).
In case of non-delivery:
If you do not receive your order within the indicated timeframes, contact our Customer Service at info@matos.be. We will search for your package with the carrier.
In case of confirmed package loss:
- We will carry out a new shipment at our expense (if the product is still available)
- Or we will fully refund you within a maximum of 14 days
You will not incur any costs related to this situation.
8 – Legal Conformity Guarantee
All products sold on our site benefit from the legal conformity guarantee provided by the Belgian Civil Code (articles 1649bis to 1649nonies), for a period of 2 years from delivery of the goods.
In case of lack of conformity:
If the delivered product does not correspond to its description, has a manufacturing defect or does not work properly, you may:
- Request repair of the product
- Request its replacement
- Request a price reduction
- Request contract termination (cancellation and refund)
For any defect appearing in the first 12 months following delivery, it is presumed to have existed at the time of delivery, unless proven otherwise by us.
Exclusions:
This guarantee does not cover: Damage resulting from abnormal use or use not in accordance with instructions Normal wear and tear of the product Damage caused by accident, negligence or mishandling on your part
How to assert your rights:
Contact us by email at info@matos.be indicating:
- Your order number
- The nature of the defect found
- Photos if possible
We will inform you of the procedure to follow.
This legal guarantee applies without prejudice to any commercial guarantee we might offer.
9 – Liability
"Matos", in the online sales process, is only bound by an obligation of means. Its liability cannot be engaged for damage resulting from the use of the Internet network such as data loss, intrusion, virus, service interruption, or other involuntary problems. The company "Matos" will not be held liable for any delay or problem in executing its obligations (delivery, etc.) when it is due to force majeure or events beyond its control making delivery impossible, such as natural disasters, bad weather, fire, explosions, floods, strikes, accidents, wars, riots, in case of impossibility to supply the country of delivery. Within the limits permitted by law, our liability is limited to the amount of the order concerned.
10 – Personal Data
"Matos" undertakes to respect the confidentiality of personal data transmitted by the Customer in accordance with the General Data Protection Regulation (GDPR). When the Customer places an order on the Site www.matos.be, Matos collects the following personal data: last name, first name, delivery and billing address, email address, telephone number.
Processing purposes:
The Customer's personal data is used to:
- Process, deliver and manage payment of their order
- Issue invoices
- Manage returns and warranty
- Send information about our products or promotions (with opt-out option)
- Improve our services
Your rights:
In accordance with GDPR, you have a right of access, rectification, erasure, limitation of processing, portability and objection regarding your personal data. "Matos" is and will remain the sole owner of data collected on its Site and will not sell, rent, or communicate this data to a third party not directly linked to its activity, except legal obligation.
11 – Archiving and Proof
"Matos" will archive order forms and invoices on a reliable and durable medium constituting a faithful copy. The computerized registers of "Matos" will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
12 – Dispute Resolution
The Site, its content, and any relationship between a Customer and "Matos" are exclusively subject to Belgian Law. In case of dispute, the Customer will address "Matos" as a priority (info@matos.be) to find an amicable solution.

In the absence of an amicable solution, Belgian Courts are solely competent, regardless of the place of delivery.
